“Chung Pak” was founded in 1980, the company headquarters is located at Unit B, 2/F., Wah Shun Industrial Building, No. 4 Cho Yuen Street, Yau Tong Bay, Kowloon, Hong Kong. Chung Pak has its own factory which is located in Gan Cun Section, Fo Chen Road, Chen Cun County, Shun De District, Fo Shan City, Guang Dong Province, China.

Since its establishment, Chung Pak is committed to develop its expertise in the professional production and sales of various types of batteries. In order to build and establish Chung Pak’s brand name and image, it has been using「」 and 「」 as the standout brand name for its production, sales and marketing of Zinc chloride and alkaline batteries for many years in Hong Kong, Mainland China and other countries abroad. Chung Pak has therefore built up its goodwill and reputation for its battery product bearing the brandname of 「」and 「」. The company has also duly registered 「」and 「」 as trademark in Hong Kong, Mainland China and other countries. Any person(s) or company(ies) who use or attempt to use the said marks by means of copy or imitation without the written authorization of the company are infringing the lawful rights of the company and thus, likely to be in violation of the relevant laws and regulations under the local legal regime.

It has recently come to the attention of Chung Pak that attempts are/were made to the use of similar trademarks/names by the third part(ies) in order to confuse the market.

They include the use of “Vimic”, “Vimie”, “Vinhie” and “FA. vinniG”, “Viririio”, “Vinlec”, “Vihlec”, “Vlnhie” which are strikingly similar, if not identical, to the company trademark「」 and 「」or packaging of battery products. Chung Pak hereby confirms that these products are not made by the Company and the user/general public should be warned of the potential quality and safety issues of those products and in particular, the legal consequences in using those products. The Company would also like to state that it has never authorized any third part(ies) to use the company’s trademark 「」 and 「」for distribution, or supply of any type of battery products.

In order to combat the trademark infringement which will no doubt cause market confusion to the public, Chung Pak has actively taken out legal actions in various jurisdictions to safeguard its rights. Below are some of the significant findings made by the relevant administrative authorities and courts:

Trademark administrative procedure:

1. According to the “Shang Ping Zi [2016] No. 0000009940″ issued by the State Administration for Industry and Commerce Trademark Office the registered trademark No. 10825326“” has been announced invalid.

2. According to the “Shang Ping Zi [2016] No. 0000085666″ issued by the State Administration for Industry and Commerce Trademark Office , the registered trademark No. 13957492 “Vinlec” has been announced invalid.

3. According to the “Shang Ping Zi [2016] No. 0000094843″ issued by the State Administration for Industry and Commerce Trademark Office, the registered trademark No. 13898980 “Viririic ” has been announced invalid.

4. According to the “Shang Ping Zi [2017] No. 0000053883″ issued by the State Administration for Industry and Commerce Trademark Office , the registered trademark No. 10758935 “FA.VINNIG” has been announced invalid on battery charges, batteries.

5. According to the “Shang Ping Zi [2017] No. 0000053884″ issued by the State Administration for Industry and Commerce Trademark Office , the registered trademark No. 9635250 “VILICT” has been announced invalid on battery, batteries charges.

6. According to the “Shang Ping Zi [2017] No. 0000132390″ issued by the State Administration for Industry and Commerce Trademark Office , the registered trademark No. 13504201 “” has been announced invalid on battery.

7. According to the “Shang Biao Yi Zi [2017] No. 0000014735″ issued by the State Administration for Industry and Commerce Trademark Office, the trademark requested for registration No. 15373084 “VINSIC” has been announced objections on Battery chargers, Battery box, Battery, Rechargeable Battery; Rechargeable Battery box.

8. According to the “Shang Biao Yi Zi [2018] No. 0000003880″ issued by the State Administration for Industry and Commerce Trademark Office, the trademark requested for registration No. 18144338 “Vincnico” has been announced objections.

9. According to the “Shang Biao Yi Zi [2018] No. 0000061467″ issued by the State Administration for Industry and Commerce Trademark Office, the trademark requested for registration No. 21612025 “VAVINING” has been announced objections.

10. According to the “Shang Ping Zi [2018] No. 0000019235″ issued by the State Administration for Industry and Commerce Trademark Office, the registered trademark No. 14608075 “Vihlec” has been announced invalid on battery, batteries charges, battery switch.

11. According to the “Shang Ping Che San Zi [2018] No. W008578″ issued by the State Administration for Industry and Commerce Trademark Office, the registered trademark No. 8773955 “VINHIE” has been revoked.

12. According to the “Shang Ping Zi [2019] No. 0000207839″ issued by the State Administration for Industry and Commerce Trademark Office, the registered trademark No. 19376156A “Yinlec” has been announced invalid on battery, batteries charges, Solar cells, plugs, sockets and other contactors (electrical connections).

13. According to the “Shang Biao Yi Zi [2020] No. 0000013804″ issued by the State Intellectual Property Office, the trademark requested for registration No. 26404298 “VINNIC” has been announced objections.

24. According to the “Shang Ping Zi [2021] No. 0000175175″ issued by the State Intellectual Property Office , the registered trademark No. 31217973 “JF Vinnic” has been announced invalid.

25. According to the “Shang Biao Yi Zi [2021] No. 0000104011″ issued by the State Intellectual Property Office, the trademark requested for registration No. 43767957 “YINIC” has been announced objection on “Power Banks (Rechargeable Batteries); Chip (Integrated Circuit)”.

26. According to the “Shang Ping Che San Zi [2021] No. W056651″ issued by the State Intellectual Property Office, the registered trademark No. 19376156A “YINLEC” has been revoked.

27. According to the “Shang Ping Che San Zi [2021] No. W056666″ issued by the State Intellectual Property Office, the registered trademark No. 14608075 “VIHLEC” has been revoked.

28. According to the “Shang Ping Che San Zi [2021] No. W062967″ issued by the State Intellectual Property Office, the registered trademark No. 14327434 “VLNHIE has been revoked.

29. According to the “Shang Biao Yi Zi [2021] No. 0000126202″ issued by the State Intellectual Property Office, the trademark requested for registration No. 38444991 “VANIKE” has been announced objections.

Patent administrative procedure:

1. According to Decisions on the Request for Invalidation issued by the Patent Re-examination Board No. 28920, the design patent (ZL201530182443.2) marked with “Vlnhie” brand name “Package (battery)” has been announced invalid.

2. According to Decisions on the Request for Invalidation issued by the Patent Re-examination Board No. 28882, the design patent (ZL201530182193.2) marked with “Vlnhie” brand name “Package (battery)” has been announced invalid.

3. According to Decisions on the Request for Invalidation issued by the Patent Re-examination Board No. 28919, the design patent (ZL201530182407.6) marked with “Vlnhie” brand name “Package (battery)” has been announced invalid.

4. According to Decisions on the Request for Invalidation issued by the Patent Re-examination Board No. 29317, the design patent (ZL201530128659.0) marked with “Vinlec” brand name “battery(VINLEC)” has been announced invalid.

5. According to Decisions on the Request for Invalidation issued by the Patent Re-examination Board No. 29315, the design patent (ZL201530128658.6) marked with “Vinlec” brand name “battery package(2)” has been announced invalid. Infringement litigation procedure:

1. In the judgement (no. 2016-Guangdong-73-Civil-Final-1134) handed down for Chung Pak (Guang Dong) Battery Industrial Co., Ltd. v. Chen Hansong trade mark infringement case, the Guangzhou Intellectual Property Court finds: that the trade mark “” owned by the Chung Pak (Guang Dong) Battery Industrial Co., Ltd. has achieved a level of reputation and goodwill in the batteries industry; and, that Chen Hansong used a similar brand indicator in respect of the same goods was identified with his malicious intent of trading on Chung Pak’s trade mark and has constituted trade mark infringement. Based on the findings, the court rules: 1. that the defendant Chen Hansong shall immediately stop the acts infringing upon the trade mark rights of Chung Pak (Guang Dong) Battery Industrial Co., Ltd. on basis of trade mark registration no. 267684; and, 2.that the defendant Chen Hansong shall make compensation of RMB300,000 to Chung Pak (Guang Dong) Battery Industrial Co., Ltd. for the economic losses suffered by the latter.

2. In the judgement (no. 2017-Guangdong-07-Civil-Trial-44) handed down for Chung Pak (Guang Dong) Battery Industrial Co., Ltd. v. Jiangmen City Jianghai District Manlishi Battery Co., Ltd. trade mark infringement case (product and sale “VInnhie” batteries), the Jiangmen Intermediate People’s Court rules: 1. that the defendant Jiangmen City Jianghai District Manlishi Battery Co., Ltd. shall immediately stop the acts infringing upon the trade mark rights of Chung Pak (Guang Dong) Battery Industrial Co., Ltd. on basis of trade mark registration no. 267684; and immediately stop using battery and battery box packaging and decoration similar to “Vinnic” battery and battery box packaging and decoration of Chung Pak (Guangdong) Battery Industry Co., Ltd., and destroy infringing goods and packaging materials. And, 2.that the defendant Jiangmen City Jianghai District Manlishi Battery Co., Ltd. shall make compensation of RMB200,000 to Chung Pak (Guang Dong) Battery Industrial Co., Ltd. for the economic losses suffered by the latter.

3. In the judgement (no. 2017-Shanghai-0107-Civil-Trial-27762) handed down for Chung Pak (Guang Dong) Battery Industrial Co. Ltd. v. Shanghai Tai Shun Battery Works Co., Ltd. trade mark infringement case regarding “vlnhie” trademark, the Shanghai Putuo District Court rules: 1. that the defendant Shanghai Tai Shun Battery Works Co., Ltd. shall immediately stop the acts infringing upon the trade mark rights of Chung Pak (Guang Dong) Battery Industrial Co., Ltd. on basis of trade mark registration no. 267684; And, 2.that the defendant Shanghai Tai Shun Battery Works Co., Ltd. shall make compensation of RMB300,000 to Chung Pak (Guang Dong) Battery Industrial Co., Ltd. for the economic losses suffered and reasonable expenses incurred to stop infringement by the latter.

4. In the judgement (no. 2018-Zhejiang- Civil-Final-680) handed down for Chung Pak (Guang Dong) Battery Industrial Co., Ltd. v. Chen Hansong trade mark infringement case, the Zhejiang Higher People’s court rules: 1. that the defendant Chen Hansong shall immediately stop using and destroying battery and battery box packaging and decoration similar to “Vinnic” battery and battery box packaging and decoration of Chung Pak (Guangdong) Battery Industry Co., Ltd. And, 2.that the defendant Chen Hansong shall make compensation of RMB100,000 to Chung Pak (Guang Dong) Battery Industrial Co., Ltd. for the economic losses suffered by the latter.

5. In the case that Chung Pak (Guang Dong) Battery Industrial Co., Ltd. sued of Ning Bo Li Bi Da Battery Co., Ltd. for “vInhie” trademark infringement, the people’s Court of Haishu District, Ningbo City announced the following agreement in the civil mediation statement (no. 2019-Zhejiang-0203-Civil-Trial-8846): 1. The defendant Ning Bo Li Bi Da Battery Co., Ltd. immediately stop infringing the exclusive right of the registered trademark of the plaintiff Chung Pak (Guang Dong) Battery Industrial Co., Ltd. “7229977”, and immediately stop using the battery and battery box packaging and decoration similar to the plaintiff’s “Vinnic” battery and battery box packaging and decoration; destroy the infringing goods and packages; 2. The trademark “Vimie” No. 31566647 and 3156647A of the defendant Ning Bo Li Bi Da Battery Co., Ltd. applied for registration shall not be used; 3. The defendant Ning Bo Li Bi Da Battery Co., Ltd. shall make compensation of RMB200,000 to the plaintiff Chung Pak (Guang Dong) Battery Industrial Co., Ltd. for the economic loss (including reasonable expenditure for rights protection).

6. In the judgement (no. 2020-Shanghai-0107-Civil-Trial-88977) handed down for Chung Pak (Guang Dong) Battery Industrial Co., Ltd. v. Wei Li Trading (Shanghai) Co., Ltd.& Jia Xing City Xin Tong Battery Co. Ltd. trade mark infringement case, the Shanghai Putuo District People’s court rules: that the defendant Wei Li Trading (Shanghai) Co., Ltd.& Jia Xing City Xin Tong Battery Co. Ltd. shall make compensation of RMB80,000 to Chung Pak (Guang Dong) Battery Industrrial Co., Ltd. for the economic losses suffered and reasonable expenses incurred in halting the infringe by the latter.

There are pending proceedings against other trademark infringement taken out by the Company. It should be noted that the Company will treat any trademark infringement seriously in order to protect its legal rights.

Safety Instructions

  • Don’t throw the batteries into fire or heat the batteries. This may cause the batteries to ignite or disrupt.
  • Don’t directly solder the batteries. This may damage their insulating tapes and protective installation.
  • Don’t use the batteries with the (+) and the (-) electrode inverse. This can damage the batteries for being over-charged or over-discharged, even may cause leakage, heat generation, disrupt, or Ignition.
  • Don’t expose the batteries to water. This can cause heat generation or rust.
  • Don’t charge batteries. This may result in venting, leakage, explosion and/or possibly fire.
  • Don’t disassemble or damage the external tubes of the batteries or modify the batteries (stack-up batteries) etc. This easily results in short-circuit, leakage, even ignition.
  • Immediately stop using the batteries if leakage, discolor or etc. with them are detected. This may cause accidents to occur.
  • Don’t drop or strongly strike the batteries. This may result in leakage, heat generation, disrupt, even ignition.
  • Be sure to use the batteries within a temperature range from 0°C to 40°C. Charge the batteries beyond the temperature range may cause leakage, heat, generation, impaired performance, and shortening of service life of the batteries.
  • Don’t use old batteries with new ones. This may cause short-circuit or heat generation.
  • Don’t use our batteries with any other type or brand of batteries. Mixed-matching of batteries may result in leakage, heat generation and bursting.
